Article 1 – Definitions

The following definitions apply to these General Terms and Conditions:

  • Withdrawal Period: The time frame in which the customer may exercise their right to cancel the purchase.

  • Consumer: A natural person not acting in the course of a trade or profession who enters into a distance contract with Monaira.

  • Continuous Contract: A distance agreement relating to a series of products and/or services over time.

  • Right of Withdrawal: The consumer’s right to cancel a distance contract within the stated withdrawal period.

  • Business: Monaira – offering products to consumers via distance sales.

  • Distance Contract: A contract concluded between the consumer and Monaira using online communication methods.

  • CESOP: The EU's Central Electronic System of Payment Information used to monitor payment service providers.

Article 3 – Scope of Application

These terms apply to all offers and agreements between the consumer and Monaira. Prior to concluding any agreement, these terms will be made electronically available to the consumer.


Article 4 – Offers

All offers on the website are non-binding. Monaira reserves the right to update or change prices and availability at any time. Prices listed include all applicable charges such as shipping, customs, and handling fees unless otherwise stated.


Article 5 – Agreement

An agreement is formed once the consumer places an order and receives a confirmation email. This confirmation marks the start of a binding agreement between both parties.

Once an order has been placed and payment has been confirmed, the agreement becomes binding. Orders cannot be cancelled after payment is completed. Any return or withdrawal can only be exercised once the order has been delivered to the customer, in accordance with Article 6 and 6a.


Article 6 – Right of Withdrawal

Consumers have the right to withdraw from their order within 14 days of receiving the product. No reason is required for cancellation. Return shipping costs are the consumer’s responsibility.


Article 6a – Exclusions from Right of Withdrawal

  • All sale and promotional items are final sale. These items cannot be returned, refunded, or exchanged under any circumstances, except if an exchange for a different size is explicitly allowed.


Article 7 – Costs in Case of Withdrawal

Upon withdrawal, Monaira will refund the consumer within 14 days after receiving the returned item, provided it is in its original condition and packaging.


Article 8 – Customs and VAT

The consumer is responsible for any applicable customs fees, import duties, taxes, and compliance with local regulations. Monaira is not the official importer of record for international orders.

Any costs incurred during customs processing, including additional charges by couriers, are the sole responsibility of the customer.

We provide appropriate shipping documents, but cannot guarantee customs clearance or local compliance. Please check your country’s import policies before ordering.


Article 9 – Compliance with CESOP

In accordance with EU law, payment service providers may report transaction data to the CESOP system. Monaira complies with these legal obligations where applicable.


Article 10 – Compliance and Warranty

All items sold are expected to meet the descriptions and standards presented. If the product arrives defective or not as expected, the customer must notify us in writing within 14 days of delivery. Returns must be in original packaging and condition.


Article 11 – Delivery

Orders are normally delivered within 30 days. If a delay occurs, the customer will be informed within 14 days after placing the order.

The customer is legally responsible for handling import and customs formalities. Monaira is not liable for customs delays or related costs. Failure to comply with customs obligations is not grounds for cancellation or refund.


Article 12 – Complaint Resolution

Complaints must be submitted via email within 7 days of discovering the issue. We aim to respond within 14 days. If more time is required, we will notify the customer with a new estimated resolution time.


Article 13 – Returns

Returns must first be registered by email at info@monaira.com.

Once approved, returns must be shipped to our designated fulfillment center:

Any returns sent to a different address will not be accepted, processed, or refunded.


Article 14 – Disputes

These terms are governed by the laws of the United States. Any disputes will first be resolved through dialogue. If unresolved, disputes will be handled by the competent court in New York, USA.
